Supreme Court to Hear Challenges to Administration’s Proposed Vaccine Requirements

On January 7, 2022, the U.S. Supreme Court will hear expedited oral arguments on the U.S. Court of Appeals (Sixth Circuit) decision to move forward with the Biden administration’s Emergency Temporary Standard (ETS) issued by the Occupational Safety and Health Administration (OSHA). The High Court will also consider regulations issued by the Centers for Medicare & Medicaid Services that affect most health care employers.

The ETS mandates that an employer with greater than 100 employees ensure that workers are fully vaccinated or allow unvaccinated employees the option of being tested once a week and wearing a facial mask.
