
Employers who maintain an entirely remote workforce due to COVID-19 can continue to proceed with the temporarily eased Form I-9 document inspection requirements (re: new hires), until the end of the year (ending December 31, 2020). This policy, introduced by U.S. Immigration and Customs Enforcement (ICE) on March 20, 2020 has now been extended five times. (Note: The most recent extension was due to end Nov. 19.)
The extension and subsequent guidance allows qualifying companies to review Section 2 of Form I-9, remotely (via video link, fax or e-mail, etc.) within three business days of the new employee’s start date.
