OSHA suspends enforcement of COVID-19 vaccine mandate for employers
After a federal appeals court upheld a stay on the Biden administration’s COVID-19 vaccine mandate for large private businesses last week – The Occupational Safety and Health Administration (OSHA) is suspending enforcement of the mandate.
OSHA published a statement on the matter, which included the following explanation, “The court ordered that we (OSHA) ‘take no steps to implement or enforce the ETS [Emergency Temporary Standard] until further court order.’ While OSHA remains confident in its authority to protect workers in emergencies, OSHA has suspended activities related to the implementation and enforcement of the ETS pending future developments in the litigation.”

U.S. Federal Appeals Court blocks administration’s vaccine rule for companies over 100The 5th U.S. Circuit Court of Appeals issued a stay, freezing the President’s efforts to require workers at U.S. companies with at least 100 employees be vaccinated against COVID-19 or be tested weekly. The Court cited “grave statutory and constitutional” issues with the rule. The stay came just days after OSHA unveiled the ETS.

President Biden announced vaccine requirement for companies with 100 or more employees
President Biden announced a new federal vaccine requirement. The new rules state that if a private company employs more than 100 employees, they must be vaccinated or will be required to be tested for COVID on a weekly basis.
Additionally, rules say that workers at a health facility that receive federal Medicare or Medicaid funding will have the vaccination requirement. Further, employees of the Executive Branch, as well as contractors who perform work for the federal government will also be requiredto follow the rules. These groups of employees will not have the option of weekly testing.
